德國聯邦最高法院指出,兩人交往時所拍下的親密照片須在前男友或前女友要求下刪除,因為此前之所以會同意拍下這些照片與兩人過往的關係密不可分,但關係結束後,前項對於拍攝的同意可能不存。法院認為,這項刪除請求權是從防免對人格權侵害所生。至於拍攝日常生活的照片則不在此列。
附帶一提,本件聯邦最高法院是於今年10月13日宣判,但判決至昨日始公布;其宣判與判決公布相距兩個月以上。
