我國在2009年批准了兩個國際人權公約,立法院通過施行法將兩公約「國內法化」至今已經五年,2013年我國也進行了第一次的「國家人權報告」審查,邀請國際人權專家來台,對於台灣的人權現況提出81點建議,其中第59點建議認為台灣至今未建立任何認定及保護難民(refugee)與尋求政治庇護者(asylum seeker)之機制、《移民法》中也無任何保護尋求庇護者的「不遣返原則」(non-refoulement)之相關規定,已違反《公民與政治權利國際公約》第七條有關於「禁止酷刑」的規定。
